It's surprising to see the one-sided agreements that are being drafted by the apartment builders. One clause says:
"The purchaser (us) shall have no objection to the Vendors(builder) allotting exclusive right and use of terrace areas and gardens on the ground and other floors to specific apartment owners"
They must be kidding!!!
Typically there is no reference to any of the gated community features boasted in the brochure like club house, swimming pool, tennis courts etc., and totally missed out on the specifications of these amenities, they are using to provide. I guess partly we are also the reason for this as we don't question them enough.
There are million clauses against the purchaser, but not even one penalty clause against builder if there is any delay in handing over the apartment.
As I am dealing with this bad experience in the past, I casually inquired some of my colleagues on the topic, and they all feel the same. Lets hope someday we have better builders to deal with. Best.
